As you know, we have been discussing the conveyance of our Greenspace Common Area to the TOKB in a collaborative effort for a community park (Greenspace) for some time, dating back to 2022. For those who offered feedback, participated in the conversations, and attended our meetings, thank you. This was a community effort and the support for this endeavor was certainly felt and appreciated.
We are pleased to announce to our membership that on 9/18/2023, Council voted to officially accept the conveyance of property. The deed was signed by both parties and was effective as of 9/21/23. The documents will be filed today and on record with the County this afternoon.
Remember, in the unlikely event this space is ever no longer is a park, the property reverts back to Beachwalk without anything having to be done. Moreover, the Town of Kure Beach has granted us a 30' easement on the Sandman lot that will be grandfathered in if this space ever reverts back to us, thus finally allowing us a street access easement.
In the coming months, there will be conversations with the Town and residents regarding the final park layout. Everyone is encouraged to attend and offer continued feedback. The initial proposed plan(s) are very respectful of the residents who live adjacent to the space, with this continuing to be a relaxing greenspace for residents to enjoy.

We are nearing the finish line, friends! The support for this project was overwhelming with over 70% of membership approval.
As previously stated, we have negotiated a 30' easement along Sandman Dr in the unlikely event that the park ceases to be a park and the lot reverts back to Beachwalk. That easement will be granted just prior to the conveyance of the GCA and will act as a placeholder, again, in the event the greenspace reverts back to BW. We anticipate the conveyance of the greenspace to be finalized with the county during the month of August.
The TOKB will then move forward with the securing of grants to fund the project. In addition to our continued dialogue with the Town, a series of community meetings will be scheduled to garner additional feedback from the community with respect to the proposed design(s). As always, we encourage community engagement and participation.

A few questions have been asked by residents. Please see below Q&A.
Q - Where will the main access to the park be and will there be access to the park from Beachwalk?
A - The primary access will be along Sandman, however Beachwalk does have a 10' pedestrian easement. This is not a well-known, public path - a low traffic area. (Platted/located at the western side of lot 23.)
Q - About 50% of the water our stormwater system handles is from the town. What in the agreement addresses stormwater from the town and Kure Dunes?
A - I (Tracy Mitchell) am the Chair for the TOKB Stormwater Committee as well as the representative for Beachwalk. I’m up to my eyeballs in stormwater, understanding the entire Town’s system (to include traversing the system in its entirety, swamps and all), and our part. 50% is debatable, however we do manage a significant amount. We can thank our developer for this gross oversight and neglect. Protecting BW is my #1 priority, and the Town is aware of our position. This park would reduce the amount of potential impervious surface that would otherwise increase the drainage and water we would be forced to manage. The Town is crystal clear on our position of more water. It should be mentioned that Town officials do understand and sympathize with us and the situation/bad hand we were dealt.
Q -You say that our cost is $400 a month to maintain that parcel. How was that figured?
A - In speaking with LU last year/contract cycle, we were in excess of $300/mo. then. The $400 cost estimation is drawn from our new contracted price with LU and those increases incurred.
Q -You mention liability. What specifically is our exposure on that particular tract? Do you have examples of what could happen that might lead to a liability claim?
A - Like all of our common areas, we are insured to cover accident and injury. This is difficult to quantitate, that’s why I generalized and spoke to the liability as a whole. We do have deductibles.
Q - You mention dues. Will our dues go down as a result of this agreement?
A - Very likely. As you know, the membership votes on our budget based on the Board’s recommendation. If we aren’t paying added LU costs to maintain this unusable space, it would certainly be a strong conversation/argument that our costs (dues) would potentially decrease or be impacted in some manner.
Q - Why didn’t you schedule an all-hands meeting for discussion before asking for signature?
A - We have had special meetings previously, to include a hybrid meeting, on this before. This communication is a follow up to those previous special meeting(s). As always, I am happy to discuss and address any question or concerns our membership may have.
I do want our membership to fully understand that we are spending money (and have been for some time now) to maintain a space that is not and cannot be utilized by no fault of our own. I can’t speak for previous Boards or even the developer. We can only make the best decision today, looking forward in the best interest of our community. This is a wonderful opportunity for Beachwalk if we don’t blow it.

As many of you know and have participated, the BW BOD reached out to our membership seeking your feedback regarding our Greenspace Common Area (GCA) and the possibility of using this space to expand upon the TOKB’s upcoming park project. For those who participated, thank you. The response was overwhelmingly in favor of contributing to and partnering with the Town in this endeavor. Since then, talks have continued with the Town and we are ready for the final steps.
Beachwalk has had the pleasure of welcoming many new families since we began these conversations. For those who are unfamiliar, Beachwalk owns a parcel (attached) that has no access to develop and is unusable. This was the result of oversight and incompetence with the original developer. We have continued to pay to maintain this area (nearly $400 monthly) and are exposed with respect to all potential liabilities associated with this space. When the Town of Kure Beach decided to create a park space in the adjacent lot, the decision was an easy one.
While most had responded in previous communications in full support, we are asking for one final signature to finalize this project. Once those signatures are recorded, the TOKB will immediately take responsibility for both maintenance and all liabilities, releasing Beachwalk from those costs.
To recap:
:: This is a conditional transfer. The moment the park ceases to be a park, the property reverts back to Beachwalk immediately without anything having to be done.
:: In the unlikely event of this reverting back to Beachwalk, the Town of Kure Beach has agreed to grant us a 30’ easement across their Sandman Lot.

There is no plan for parking apart from perhaps a few potential spaces for golf carts; a low traffic area.

10/29/22 Based on the overwhelming support of Beachwalk residents and the financial savings, we will be moving forward with this Greenspace Common Area project with the Town of Kure Beach. Updates will be provided to all Beachwalk residents as that information becomes available. Stay tuned.
